TRADEMARK USAGE GUIDELINES

Virtuozzo takes great care to protect its trademarks, logos and design marks (collectively, “Trademark(s)”), as they are valuable proprietary assets of the company. A list of the Trademarks can be found here. In order to be able to use the Trademarks, you should be allowed to do so based on your existing agreement with Virtuozzo. In this case, your use of the Trademarks will be governed by the terms of the respective agreement, together with these Guidelines, as amended from time to time by Virtuozzo in its sole discretion.

Ownership

You should only use the Trademarks for the purpose of including the Trademarks in your advertising, promotional, and sales materials, as described in your agreement with Virtuozzo. By using the Trademarks, you acknowledge that Virtuozzo is the sole and exclusive owner of all rights, titles, and interests in and to the Trademarks. You shall not make or assert any claim of ownership of the Trademarks, nor dispute the rights of Virtuozzo as sole owner of the Trademarks. You shall not register or attempt to register the Trademark or any imitation thereof, including without limitation any joint registration of the Trademark with other signs. By using the Trademarks, you acknowledge the value and goodwill associated with the Trademarks and the exclusive ownership thereof by Virtuozzo. You agree that you will not harm, misuse, or bring into disrepute any Trademarks. Should any rights related to the Trademark become vested in you, you agree to assign, and hereby assign, all such rights to Virtuozzo free of additional consideration or costs.

Prohibited Use

You shall not use the Trademarks in any product, service or business name or any Internet domain
name, nor use, reserve or register as a search term or metatag the Trademarks to attract traffic to any web site other than a site operated by Virtuozzo or its affiliates. You cannot shorten, abbreviate, or modify the Trademarks or use them as part of a combined mark. You may not use the Trademarks in a manner which would cause confusion as to Virtuozzo sponsorship, affiliation, or endorsement. When using the Trademarks, you should not depict Virtuozzo in a false or derogatory light.

Proper Use

You shall always spell the Trademarks exactly as they are shown in the Trademarks list referenced above. You will not modify, alter or amend the Trademarks in any way. The Virtuozzo logo must be
displayed only as advised by Virtuozzo.

Trademark Notice

You should always use the proper trademark ownership notice when displaying a Trademark in order to certify the ownership of Virtuozzo of the relevant Trademark.

Trademark Symbols

You must use the appropriate trademark symbol (TM, ®) the first time that the Trademark appears in the text of the material. After that the trademark symbol is not required.

Credit Notice

All the materials bearing any Trademark should be accompanied by the following text in the credit
notice section of the materials:

“__________is a registered trademark of Virtuozzo International GmbH and or its affiliates in the United States and other countries.“

Additional Guidelines

Virtuozzo may amend these guidelines or provide you with any additional guidelines for using the
Trademarks upon its sole discretion. Additional guidelines may also be included in your respective
agreement with Virtuozzo. Virtuozzo reserves the right to discontinue your use of any of the Trademarks in case your usage doesn‘t comply with the relevant terms and conditions.

Unathorized Usage of the Trademarks

Any usage of the Trademarks that does not comply with these guidelines and is not based on a
respective agreement with Virtuozzo allowing such usage, is strictly forbidden. Virtuozzo may authorize the use of the Trademarks by a third party on the basis of a written license agreement.

In certain circumstances the use of the Trademarks by an unauthorized third party will not be unlawful. The nature and extent of the legitimate use is in any case restricted by trademark and unfair competition laws and is limited to the minimum usage necessary under the circumstances.

All unauthorized but legitimate use of the Trademarks should be accompanied by a clear statement that the third party is not affiliated or endorsed by Virtuozzo. As an example:

“Please note that __________Inc. is not in any way affiliated with Virtuozzo International GmbH and
that Virtuozzo International GmbH and its affiliates are not responsible for the content or accuracy of this [website] or for the content, performance, or quality of _________ Inc.’s products or services.”
